Not-at-Fault Accident Claims and Getting Repaired
By Tanu Menon
What happens when another driver causes the crash — using their liability vs. your collision coverage, and how to keep repairs moving.
When the other driver is at fault
In many cases, the at-fault driver's liability insurance is primary for your vehicle damage and injuries. You may also choose to use your own collision coverage first (if you have it) for faster repairs, then let carriers handle reimbursement — options vary by state and situation.
Information that helps your claim
- Other driver's name, phone, insurer, and policy number
- Police report number when one is filed
- Witness contacts
- Clear photos of damage and the scene
- Medical documentation if you were injured
Uninsured drivers
If the at-fault driver has little or no insurance, uninsured/underinsured motorist coverage on your policy can become critical. See our state minimum blogs for liability floors by state.
